    Dealing with Problem Tenants

    Renting out an Austin home can be an efficient and enjoyable way to earn some money, especially with our city's real estate market in its current good shape. There can certainly be downsides, however. One problem in particular that every landlord worries about is problem tenants: people who are too noisy, neglect to care for their property, and even fail to pay their rent.

    If you find yourself with difficult tenants, there is no need to give up. Here are a few tips to help you deal with this unpleasant situation.

    Know the Law

    While you certainly have certain rights as a property owner, tenants are also given many rights by law. Review the lease you give to renters carefully and make sure you stay within legal boundaries. It may be best to contact an attorney, just to make sure you are clear on your rights and responsibilities.

    Treat Each Tenant the Same

    This can be a particularly frustrating rule to follow, but it is necessary. If you are seen as singling one person or family out for special treatment, you could be accused of taking illegal retaliatory or discriminatory measures. For example, you may want to send general notifications about acceptable behaviors to everyone living on your property, instead of sending a warning to any specific person.

    Talk First

    If you are considering eviction, discuss the problem with the tenants in question first. Give them a chance to explain their circumstances and improve their behavior. Be sure to look up the regulations for eviction in your area, as every municipality has a different eviction process.
